AUTOMOBILE vs. PEDESTRIAN • CASE #2

DATE OF OCCURRENCE: 6/27/2001

CLIENT: M.M. (34 year-old female)

DESCRIPTION OF OCCURRENCE: Our client, M.M., was walking with her child, crossing 69th Avenue, at its intersection with 60th Lane, in Ridgewood, Queens. An S.U.V. ran a stop sign and knocked her to the ground, causing loss of consciousness.

INJURIES: Fracture of left shoulder, with deformity; fracture of pubic ramos (pelvis).

TREATMENT:

Emergency Room and admitted to Elmhurst Hospital for approximately two weeks.

Surgery on 11/15/2004: Arthroscopic repair of left shoulder

RESULT: Settlement for $400,000 in April, 2005.

OF PARTICULAR INTEREST HERE:

1. M.M. worked as a secretary at a New York City High School. She was eventually able to return to work, but even after her shoulder surgery her left shoulder was still not 100%. She had pain and weakness in the shoulder, and restricted ranges of motion.

2. My office retained a vocational economic expert, who found that even though M.M. was back at work full time, she did not have the same earning ability as a fully "able" worker. The vocational economist found that while she was earning the same salary, M.M did not have the same expected worklife and that her lifetime earning ability would be less. He calculated that the present value of M.M.'s lifetime earnings loss was $261,884.

3. My office also hired medical-legal artists to prepare drawings depicting M.M.'s injuries and her surgery. These drawings were shown to the S.U.V.'s attorneys and, had the case not settled, the drawings would have been presented to the jury at trial.
